What Is A Drug or Alcohol Evaluation?

In New York State, the Office of Addiction Services and Support (OASAS) in collaboration with the Department of Motor Vehicles develops and monitors the standards for conducting Impaired Driver Screening and Assessments.

In nearly all impaired driver cases, the court will require a clinical assessment. Clinical screening and assessment may also be required for other criminal offenses or civil matters in which there is a concern about alcohol and/or drug use. There may also be a need for assessment for Employee and HR issues, medical conditions or other family matters.

Screening is a process for evaluating the possible presence of a substance use problem. Assessment is a process for defining the nature of the problem, determining a diagnosis and develop specific treatment recommendations if indicated.

What to Expect

Steps in the Process:

Assessments are generally one to two appointments.  They must be conducted by a NYS licensed professional who has been approved and trained by OASAS to conduct Impaired Driver Assessments.

Step 1:

We begin with completing a series of consent forms allowing the evaluator to communicate with your attorney, update the DMV Impaired Driver System with the date and outcome of the assessment, and speak with a collateral contact.

Step 2:

We review the story about the incident that led to the need for the assessment and look at the arrest report, if available, at the time of the interview. If not, we’ll ask you to obtain a copy from your attorney for us to review.

Step 3:

A full psycho-social interview is done in order to learn about your health, education, family, employment, legal and mental health history.

The interview also includes an in-depth review of your experience with alcohol and/or drug use both related to the incident and how it is for you in general.

Step 4:

We then complete a series of standardized questionnaires that are used to objectively assess alcohol and drug use both within the past one year and lifetime use.

Step 5:

A urine toxicology screen is required in most cases. We do the screening in our office and it is sent out to Labcorp for processing.

Step 6:

With your permission, we conduct a brief conversation by phone or in-person with someone who knows you who can provide supporting and character information.

Step 7:

Discussion and Recommendations. We do not submit an evaluation report to your attorney without discussing it with you first and explaining any recommendations for treatment or counseling. At this point, we have had a lengthy discussion, we’ve covered many topics and we are prepared to discuss our findings and recommendations for next steps.

Step 8:

If counseling and treatment are recommended we work with you to understand your needs, meet your goals and develop an individualized plan for success, while maintaining the high standards of care for which we have developed a reputation over the past 12 years.

Step 9:

We help you every step of the way with the DMV and relicensing as well as ensuring that all requirements are met for court, Probation, TASC or any other supervising entity.
